G\u00fclmez, 2021 Aral\u0131k ay\u0131nda y\u00fcr\u00fct\u00fclen asgari \u00fccret tespit s\u00fcrecinin hukuka ayk\u0131r\u0131l\u0131\u011f\u0131n\u0131 ayr\u0131nt\u0131lar\u0131 ile anlatt\u0131\u011f\u0131 makalesinde \u015fu g\u00f6r\u00fc\u015flere yer verdi:<\/p>\n<blockquote><p>&#8220;16 Aral\u0131k 2021\u2019de a\u00e7\u0131klanan asgari \u00fccret karar\u0131n\u0131n tarihselli\u011finin vurgulamak istedi\u011fim boyutu, resm\u00ee a\u00e7\u0131klamalarda oldu\u011fu gibi, tutar\u0131 ve zam oran\u0131 de\u011fildi ku\u015fkusuz. \u0130lk kez tan\u0131k olunan, T\u00fcrk-\u0130\u015f\u2019in ve Cumhurba\u015fkanl\u0131\u011f\u0131\u2019n\u0131n a\u00e7\u0131klamalar\u0131yla kamuoyuna duyurulan \u201c<strong><em>hukuksuzluklar<\/em><\/strong>\u201d idi. Komisyon\u2019un, ge\u00e7mi\u015f uygulamalarda bir ba\u015fka \u00f6rne\u011fi bulunmayan, al\u0131\u015f\u0131lmad\u0131k bir y\u00f6ntemle \u201ckesin karar\u201d alarak de\u011fil, Bakanl\u0131k arac\u0131l\u0131\u011f\u0131yla \u201cdan\u0131\u015fsal g\u00f6r\u00fc\u015f\u201d bildirerek yar\u0131m y\u00fczy\u0131l\u0131 a\u015fk\u0131n bir s\u00fcreden beri kulland\u0131\u011f\u0131 yetkisini, bu kez bir \u201calt s\u0131n\u0131r belirlemek\u201dle yetinerek Cumhurba\u015fkan\u0131\u2019na devretmi\u015f olmas\u0131n\u0131n ba\u015fka bir tan\u0131m\u0131 olamaz.<\/p>\n<p><strong><em>Y\u00fcr\u00fcrl\u00fckteki kurallar, ne Komisyon\u2019a ve ne de Cumhurba\u015fkan\u0131\u2019na b\u00f6yle bir yetki tan\u0131m\u0131\u015ft\u0131r. <\/em><\/strong><\/p>\n<p>Kamuoyundaki tart\u0131\u015fmalarda, \u00f6ncelikle saptanacak ve saptanan tutar\u0131n ele al\u0131n\u0131p ger\u00e7ek sat\u0131n alma g\u00fcc\u00fcn\u00fcn g\u00fcnden g\u00fcne eridi\u011finin vurgulanmas\u0131, son derece hakl\u0131 bir tutumdur ve \u00f6ncelikli bir sorundur ku\u015fkusuz.<\/p>\n<p>Ama, s\u00f6zl\u00fc ve yaz\u0131l\u0131 olarak hemen her g\u00fcn duyduklar\u0131m\u0131z\u0131n, ya\u015fad\u0131klar\u0131m\u0131z\u0131n ve kimilerinin de y\u0131llard\u0131r s\u00fcregeldi\u011fine tan\u0131k olduklar\u0131m\u0131z\u0131n yan\u0131nda \u201cs\u00f6z\u00fc bile edilemeyecek\u201d denli \u00f6nemsiz say\u0131labilece\u011fi d\u00fc\u015f\u00fcn\u00fclebilecek, hatta \u201cdevede kulak kald\u0131\u011f\u0131\u201d s\u00f6ylenebilecek bu hukuksuzluklar\u0131n da g\u00f6rmezden gelinip sineye \u00e7ekilmemesi gerekir.<\/p>\n<p>Ne yaz\u0131k ki, ba\u015fta T\u00fcrk-\u0130\u015f olmak \u00fczere Komisyon, 16 Aral\u0131k 2021 karar\u0131yla, \u0130\u015f Hukuku\u2019nun son derece \u00f6nemli, ba\u011f\u0131ms\u0131z ve \u00f6zerk bir kurumuna \u201ctarihsel bir g\u00f6lge\u201d d\u00fc\u015f\u00fcrm\u00fc\u015ft\u00fcr.&#8221;<\/p>\n<figure id=\"attachment_2638\" aria-describedby=\"caption-attachment-2638\" style=\"width: 1024px\" class=\"wp-caption alignnone\"><a href=\"http:\/\/arastirma.disk.org.tr\/wp-content\/uploads\/2022\/01\/ASGARI-UCRETIN-FIILEN-CUMHUR-HUKUKUNA-UYARLANMASI-20.01.2022.pdf\"><img fetchpriority=\"high\" decoding=\"async\" class=\"wp-image-2638 size-large\" src=\"http:\/\/arastirma.disk.org.tr\/wp-content\/uploads\/2020\/08\/g\u00fclmez-1024x683.jpg\" alt=\"\" width=\"1024\" height=\"683\" srcset=\"https:\/\/arastirma.disk.org.tr\/wp-content\/uploads\/2020\/08\/g\u00fclmez-1024x683.jpg 1024w, https:\/\/arastirma.disk.org.tr\/wp-content\/uploads\/2020\/08\/g\u00fclmez-300x200.jpg 300w, https:\/\/arastirma.disk.org.tr\/wp-content\/uploads\/2020\/08\/g\u00fclmez-768x512.jpg 768w, https:\/\/arastirma.disk.org.tr\/wp-content\/uploads\/2020\/08\/g\u00fclmez-1536x1025.jpg 1536w, https:\/\/arastirma.disk.org.tr\/wp-content\/uploads\/2020\/08\/g\u00fclmez-2048x1366.jpg 2048w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/a><figcaption id=\"caption-attachment-2638\" class=\"wp-caption-text\">Mesut G\u00fclmez D\u0130SK taraf\u0131ndan d\u00fczenlenen ILO 100.
